บริษัท เอเชีย โกลบอล แทรคกิ้ง จำกัด (“AGT” หรือ “เรา”) จัดทำนโยบายนี้เพื่ออธิบายว่าแอป AGT GPS V3 (“แอป”) เก็บ ใช้ และเปิดเผยข้อมูลส่วนบุคคลอย่างไร ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562

1. ผู้ควบคุมข้อมูลส่วนบุคคล

แอปนี้เผยแพร่บน Google Play ในชื่อผู้พัฒนา ASIA GLOBAL TRACKING COMPANY LIMITED และบน App Store ในชื่อผู้พัฒนา Wittaya Phanmuang ซึ่งเผยแพร่แอปในนามของบริษัท

2. ผู้ใช้แอปและบทบาทของ AGT

แอปนี้สำหรับลูกค้าธุรกิจที่ใช้บริการติดตามรถของ AGT บัญชีผู้ใช้สร้างโดย AGT เท่านั้น ผู้ใช้สร้างบัญชีในแอปไม่ได้ แอปไม่มีการซื้อภายในแอปและไม่มีโฆษณา

• AGT เป็นผู้ควบคุมข้อมูลส่วนบุคคล สำหรับข้อมูลบัญชีผู้ใช้ ข้อมูลการเข้าสู่ระบบ ข้อมูลทางเทคนิคของแอป และคำขอภาพแผนที่ (ข้อ 3.1, 3.2, 3.5 และ 3.6)
• บริษัทลูกค้าเป็นผู้ควบคุมข้อมูลส่วนบุคคล และ AGT เป็นผู้ประมวลผลข้อมูลส่วนบุคคล ตามสัญญาบริการ สำหรับข้อมูลรถ ตำแหน่งรถ และข้อมูลคนขับ (ข้อ 3.3 และ 3.4) หากคุณมีคำถามหรือต้องการใช้สิทธิเกี่ยวกับข้อมูลกลุ่มนี้ โปรดติดต่อบริษัทของคุณ หรือติดต่อ AGT แล้วเราจะประสานกับบริษัทของคุณ

3. ข้อมูลที่แอปประมวลผล

3.1 ข้อมูลบัญชีผู้ใช้

AGT เก็บข้อมูลบัญชีไว้ที่ server ของ AGT ได้แก่ ชื่อผู้ติดต่อ ชื่อบริษัท (กรณีเป็นบริษัท) เบอร์โทรศัพท์ อีเมล และรหัสผ่าน ข้อมูลบัญชีจำเป็นต่อการเข้าสู่ระบบ หากไม่มีข้อมูลนี้ คุณจะใช้แอปไม่ได้

3.2 ข้อมูลการเข้าสู่ระบบ

• เมื่อเข้าสู่ระบบ แอปส่งอีเมลและรหัสผ่านไปที่ server ของ AGT
• ทุกครั้งที่ขอข้อมูล แอปส่ง session token เพื่อยืนยันว่าคุณเข้าสู่ระบบอยู่
• server ของ AGT บันทึก log การเข้าสู่ระบบ ได้แก่ อีเมล ที่อยู่ IP และวันเวลาที่เข้าสู่ระบบ

3.3 คำขอค้นหาที่อยู่

เพื่อแสดงที่อยู่ของตำแหน่งรถ แอปส่งพิกัดรถ (ทศนิยม 4 ตำแหน่ง) และภาษาที่ใช้ไปที่ server ของ AGT โดยไม่แนบ session token และไม่แนบรหัสรถ

3.4 ข้อมูลรถ ตำแหน่งรถ และข้อมูลคนขับ (ข้อมูลของบริษัทลูกค้า)

ข้อมูลกลุ่มนี้มาจากอุปกรณ์ GPS ในรถของบริษัทลูกค้า ส่งไปเก็บที่ server ติดตามรถของ AGT (ซอฟต์แวร์ GPSWOX) แอปดึงมาแสดงเท่านั้น ได้แก่ ตำแหน่งและสถานะรถ รายการรถ รายละเอียดรถ เส้นทางย้อนหลัง การแจ้งเตือนภายในแอป เขตพื้นที่และจุดสนใจ และชื่อคนขับจากการรูดบัตรล่าสุด

3.5 ข้อมูลทางเทคนิคเพื่อแก้ไขปัญหาของแอป

• Sentry (บริการรายงานแอปขัดข้อง): รายงานข้อผิดพลาดและรายงานแอปขัดข้อง (crash) ข้อมูลรอบการใช้งานแอป (app session ซึ่งไม่ใช่ session token สำหรับเข้าสู่ระบบ) เพื่อสถิติความเสถียรของแอป รุ่นแอป รุ่นอุปกรณ์ ระบบปฏิบัติการ และรหัสสุ่มประจำการติดตั้งแอป รายงานจากส่วน JavaScript ของแอปถูกกรองเพื่อตัดข้อมูลส่วนบุคคลออกก่อนส่ง แต่รายงานแอปขัดข้องระดับระบบ (native) อาจมีข้อมูลทางเทคนิคที่ไม่ผ่านการตัดข้อมูลนี้ รายงานใน Sentry ไม่ผูกกับอีเมลหรือบัญชีผู้ใช้ และเราตั้งค่าไม่ให้ Sentry จัดเก็บที่อยู่ IP
• Expo (บริการอัปเดตแอป EAS Update): รหัสสุ่มประจำการติดตั้งแอป รุ่นแอป และแพลตฟอร์ม เพื่อตรวจและส่งอัปเดตแอป หากแอปเปิดไม่ขึ้นเพราะข้อผิดพลาดร้ายแรง แอปจะส่งข้อความแสดงข้อผิดพลาดยาวไม่เกิน 1,024 ตัวอักษรไปที่ Expo เมื่อตรวจอัปเดตครั้งถัดไป ข้อความนี้ไม่ผ่านการตัดข้อมูล

นอกจากนี้ เมื่อแอปเชื่อมต่อกับ server ใด ผู้ให้บริการปลายทางจะได้รับที่อยู่ IP ของอุปกรณ์ตามกลไกปกติของการเชื่อมต่ออินเทอร์เน็ต

3.6 คำขอภาพแผนที่

แอปขอภาพแผนที่ของบริเวณที่คุณกำลังดูจาก Longdo Map และใช้ OpenFreeMap เป็นผู้ให้บริการสำรอง คำขอเหล่านี้ไม่มีข้อมูลบัญชีหรือข้อมูลรถ

3.7 ข้อมูลที่ส่งไปแอปอื่นเมื่อคุณกดเอง

• เมนูแชร์ของอุปกรณ์: ชื่อรถ เวลาของตำแหน่งล่าสุด ที่อยู่ และลิงก์ Google Maps ไปยังแอปที่คุณเลือก
• เปิดแผนที่นำทาง: พิกัดรถไปยังแอปนำทาง
• โทรหา AGT: เบอร์โทรศัพท์ของ AGT ไปยังแอปโทรศัพท์
• คัดลอกข้อความ: เมื่อคุณกดค้างที่ชื่อรถ ทะเบียน ที่อยู่ รุ่นอุปกรณ์ IMEI หรือวันหมดอายุ แอปจะคัดลอกข้อความนั้นไปที่คลิปบอร์ดของอุปกรณ์ จากนั้นข้อความจะอยู่ในคลิปบอร์ดของระบบปฏิบัติการ ซึ่งแอปอื่นอ่านได้ตามกฎของระบบปฏิบัติการ เช่น เมื่อคุณวางข้อความ แอปไม่คัดลอกข้อมูลคนขับหรือพิกัด และไม่บันทึกหรือส่งข้อความที่คัดลอกไปที่ใด

เมื่อส่งไปแล้ว ข้อมูลจะอยู่ภายใต้นโยบายของแอปหรือผู้รับปลายทางนั้น

3.8 ข้อมูลที่เก็บไว้ในอุปกรณ์ของคุณเท่านั้น

• session token และอีเมลที่จำไว้ (เมื่อเลือก “จดจำฉัน”) เก็บใน secure storage ของระบบปฏิบัติการ
• cache ที่อยู่ เก็บในโฟลเดอร์ cache ของระบบปฏิบัติการ แอปไม่ได้เข้ารหัสเอง แต่ได้รับการคุ้มครองด้วยการเข้ารหัสข้อมูลของระบบปฏิบัติการ cache นี้ถูกลบไปพร้อมแอป และบน iOS ไม่รวมอยู่ในข้อมูลสำรองของเครื่อง
• การตั้งค่าแอป รายการรถที่ซ่อน ค่าสวิตช์แผนที่ สถานะอ่านแล้วของการแจ้งเตือน และ cache แผนที่

เมื่อออกจากระบบ แอปจะลบ session token, cache ที่อยู่, รายการรถที่ซ่อน, ค่าสวิตช์แผนที่ และสถานะอ่านแล้วของการแจ้งเตือนออกจากอุปกรณ์ ส่วนอีเมลที่จำไว้จะยังอยู่จนกว่าคุณจะเอาเครื่องหมาย “จดจำฉัน” ออก

3.9 ข้อมูลที่แอปไม่เก็บและไม่ส่ง

• ตำแหน่งของคุณเอง: แอปใช้ตำแหน่งของอุปกรณ์เฉพาะเมื่อคุณกดปุ่ม “ตำแหน่งของฉัน” ขณะเปิดหน้าแผนที่ เพื่อแสดงบนแผนที่ในอุปกรณ์เท่านั้น แอปไม่ใช้ตำแหน่งเบื้องหลัง และไม่ส่งตำแหน่งของคุณออกจากอุปกรณ์
• Face ID และลายนิ้วมือ: ระบบปฏิบัติการเป็นผู้ตรวจสอบ แอปได้รับเพียงผลว่าสำเร็จหรือไม่สำเร็จ
• ข้อมูลดิบจากบัตรคนขับ เบอร์ SIM รายชื่อติดต่อ รูปภาพ ไฟล์ ข้อความ ปฏิทิน ข้อมูลสุขภาพ และข้อมูลการเงิน
• แอปไม่มีเครื่องมือวิเคราะห์พฤติกรรมการใช้งาน (analytics) ไม่มีโฆษณา ไม่ติดตามคุณข้ามแอปหรือเว็บไซต์อื่น และ AGT ไม่ขายข้อมูล

4. วัตถุประสงค์และฐานทางกฎหมาย

AGT ไม่ใช้ข้อมูลที่ประมวลผลผ่านแอปเพื่อวัตถุประสงค์อื่นนอกเหนือจากที่ระบุในนโยบายนี้

5. ผู้รับข้อมูล

Sentry, Expo, Longdo Map และ OpenFreeMap ประมวลผลข้อมูลตามข้อกำหนดการให้บริการและนโยบายความเป็นส่วนตัวของตน AGT เลือกใช้ผู้ให้บริการเหล่านี้โดยพิจารณาว่าให้ความคุ้มครองข้อมูลในระดับเดียวกันหรือเทียบเท่ากับที่ระบุในนโยบายนี้ นอกจากนี้ AGT อาจเปิดเผยข้อมูลเมื่อกฎหมายหรือคำสั่งของหน่วยงานที่มีอำนาจตามกฎหมายกำหนด

6. การส่งข้อมูลไปต่างประเทศ

server ของ AGT ตั้งอยู่ในประเทศไทย ข้อมูลทางเทคนิคในข้อ 3.5 และคำขอภาพแผนที่สำรองจะถูกส่งไปยังผู้ให้บริการในต่างประเทศ ได้แก่ Sentry (เยอรมนี) Expo (สหรัฐอเมริกา) และ OpenFreeMap (ฮังการี) รายงานใน Sentry ไม่ผูกกับบัญชีผู้ใช้ และ AGT ไม่ได้ส่งข้อมูลบัญชีไปพร้อมข้อมูลที่ส่งให้ Expo หรือ OpenFreeMap เยอรมนีและฮังการีอยู่ภายใต้กฎหมายคุ้มครองข้อมูลของสหภาพยุโรป (GDPR)

7. ระยะเวลาเก็บข้อมูล

8. การรักษาความปลอดภัย

• การส่งข้อมูลทั้งหมดของแอปเข้ารหัสระหว่างทางด้วย HTTPS
• session token และอีเมลที่จำไว้เก็บใน secure storage ของระบบปฏิบัติการ ส่วน cache ที่อยู่ได้รับการคุ้มครองด้วยการเข้ารหัสข้อมูลของระบบปฏิบัติการ
• การยืนยันตัวตนด้วย Face ID หรือลายนิ้วมือทำโดยระบบปฏิบัติการ

ไม่มีวิธีส่งหรือเก็บข้อมูลทางอินเทอร์เน็ตใดที่ปลอดภัยได้ 100% แต่เราใช้มาตรการข้างต้นเพื่อคุ้มครองข้อมูลของคุณ

9. สิทธิของเจ้าของข้อมูล

ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 คุณมีสิทธิ

• ขอเข้าถึงและขอรับสำเนาข้อมูลของคุณ (มาตรา 30)
• ขอรับหรือขอให้ส่งโอนข้อมูลในรูปแบบที่อ่านได้ทั่วไป (มาตรา 31)
• คัดค้านการประมวลผลข้อมูล (มาตรา 32)
• ขอให้ลบหรือทำลายข้อมูล (มาตรา 33)
• ขอให้ระงับการใช้ข้อมูล (มาตรา 34)
• ขอให้แก้ไขข้อมูลให้ถูกต้อง (มาตรา 35)
• ร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (สคส.) ที่ www.pdpc.or.th (มาตรา 73)

ส่งคำขอใช้สิทธิทางอีเมลถึง info@asiaglobaltracking.com จากอีเมลที่ใช้เข้าสู่ระบบแอป เราจะดำเนินการโดยไม่ชักช้าและภายใน 30 วันนับจากวันที่ได้รับคำขอ สำหรับการลบบัญชี โปรดดู หน้าขอลบบัญชีและข้อมูล ในบางกรณีเราอาจปฏิเสธคำขอได้ตามที่กฎหมายกำหนด และจะแจ้งเหตุผลให้คุณทราบ

สำหรับข้อมูลรถ ตำแหน่งรถ และข้อมูลคนขับ บริษัทลูกค้าเป็นผู้ควบคุมข้อมูล โปรดติดต่อบริษัทที่เกี่ยวข้อง หรือติดต่อ AGT แล้วเราจะประสานให้

10. ผู้เยาว์

แอปนี้สำหรับผู้ใช้ทางธุรกิจ และไม่ได้มุ่งให้ผู้เยาว์ใช้งาน

11. การเปลี่ยนแปลงนโยบาย

เมื่อมีการปรับปรุงนโยบายนี้ เราจะประกาศฉบับใหม่บนหน้านี้และปรับวันที่มีผลบังคับด้านบน

Asia Global Tracking Company Limited (“AGT”, “we”) explains in this policy how the AGT GPS V3 app (the “App”) collects, uses and discloses personal data, in line with Thailand’s Personal Data Protection Act B.E. 2562 (2019) (“PDPA”).

1. Data controller

The App is published on Google Play under the developer name ASIA GLOBAL TRACKING COMPANY LIMITED, and on the App Store under the developer name Wittaya Phanmuang, who publishes the App on behalf of the company.

2. Who uses the App and AGT’s role

The App is for business customers that use AGT’s vehicle tracking service. User accounts are created by AGT only; accounts cannot be created in the App. The App has no in-app purchases and no advertising.

• AGT is the data controller for user account data, sign-in data, the App’s technical data and map image requests (sections 3.1, 3.2, 3.5 and 3.6).
• The customer company is the data controller, and AGT is a data processor under the service agreement, for vehicle, vehicle location and driver data (sections 3.3 and 3.4). For questions or rights requests about this data, please contact your company, or contact AGT and we will coordinate with your company.

3. Data the App processes

3.1 User account data

AGT stores the following account data on its servers: contact name, company name (if a company), phone number, email address and password. Account data is needed to sign in; without it you cannot use the App.

3.2 Sign-in data

• When you sign in, the App sends your email address and password to AGT’s server.
• With each data request, the App sends a session token to confirm you are signed in.
• AGT’s server keeps a sign-in log with your email address, IP address and sign-in date and time.

3.3 Address lookups

To show the address of a vehicle’s position, the App sends the vehicle coordinates (4 decimal places) and the display language to AGT’s server, without a session token and without a vehicle ID.

3.4 Vehicle, vehicle location and driver data (customer company data)

This data comes from GPS devices in the customer company’s vehicles and is stored on AGT’s tracking server (GPSWOX software). The App only retrieves and displays it: vehicle position and status, vehicle list, vehicle details, route history, in-app alerts, geofences and points of interest, and the driver name from the most recent card swipe.

3.5 Technical data for fixing App problems

• Sentry (crash reporting service): error and crash reports, app usage-session data for App stability statistics (not your sign-in token), App version, device model, operating system and a random installation ID. Reports from the App’s JavaScript code are filtered to remove personal data before sending, but native-level crash reports may contain technical data that does not pass through this filter. Reports in Sentry are not linked to your email address or user account, and we have configured Sentry not to store IP addresses.
• Expo (app update service, EAS Update): a random installation ID, App version and platform, to check for and deliver App updates. If the App cannot start because of a serious error, the App sends an error message of up to 1,024 characters to Expo at the next update check. This message is not filtered.

In addition, whenever the App connects to a server, that provider receives the device’s IP address as a normal part of an internet connection.

3.6 Map image requests

The App requests map images of the area you are viewing from Longdo Map, with OpenFreeMap as a backup provider. These requests contain no account data or vehicle data.

3.7 Data sent to other apps when you choose to

• Device share menu: vehicle name, time of last position, address and a Google Maps link, to the app you choose.
• Open navigation: the vehicle coordinates, to your navigation app.
• Call AGT: AGT’s phone number, to your phone app.
• Copy text: when you long-press the vehicle name, registration number, address, device model, IMEI or expiry date, the App copies that text to the device clipboard. The text then stays in the operating system’s clipboard, which other apps can read under the operating system’s rules, for example when you paste it. The App does not copy driver data or coordinates, and does not store or send the copied text anywhere.

Once sent, the data is subject to the policy of the receiving app or recipient.

3.8 Data stored only on your device

• Session token and remembered email (if you choose “Remember me”), in the operating system’s secure storage.
• Address cache, kept in the operating system’s cache folder. The App does not encrypt it itself; it is protected by the operating system’s data encryption. It is deleted together with the App, and on iOS it is not included in device backups.
• App settings, hidden vehicle list, map toggle settings, read status of alerts, and map cache.

When you sign out, the App deletes the session token, the address cache, the hidden vehicle list, the map toggle settings and the read status of alerts from the device. Your remembered email stays until you untick “Remember me”.

3.9 Data the App does not collect or send

• Your own location: the App uses the device location only when you tap “My location” while the map screen is open, to show it on the map on your device. The App does not use location in the background and does not send your location off the device.
• Face ID and fingerprint: the operating system performs the check; the App only receives a success or failure result.
• Raw driver card data, SIM number, contacts, photos, files, messages, calendar, health data and financial data.
• The App has no usage analytics, no advertising and no cross-app or cross-website tracking, and AGT does not sell data.

4. Purposes and legal bases

AGT does not use data processed through the App for purposes other than those stated in this policy.

5. Recipients

Sentry, Expo, Longdo Map and OpenFreeMap process data under their own terms of service and privacy policies. AGT uses these providers on the basis that they protect data at the same or an equivalent level as described in this policy. AGT may also disclose data when required by law or by an order of a competent authority.

6. International transfers

AGT’s servers are located in Thailand. The technical data in section 3.5 and backup map image requests are sent to providers outside Thailand: Sentry (Germany), Expo (United States) and OpenFreeMap (Hungary). Reports in Sentry are not linked to user accounts, and AGT does not send account data with the data sent to Expo or OpenFreeMap. Germany and Hungary are subject to the EU General Data Protection Regulation (GDPR).

• All App data transmissions are encrypted in transit with HTTPS.
• The session token and remembered email are kept in the operating system’s secure storage, and the address cache is protected by the operating system’s data encryption.
• Face ID and fingerprint checks are performed by the operating system.

No method of transmitting or storing data over the internet is 100% secure, but we use the measures above to protect your data.

9. Your rights

Under the PDPA, you have the right to:

• access and obtain a copy of your data (s.30);
• receive your data, or have it transferred, in a commonly readable format (s.31);
• object to processing (s.32);
• request erasure or destruction of your data (s.33);
• request restriction of use (s.34);
• request correction of your data (s.35);
• lodge a complaint with the Office of the Personal Data Protection Committee (PDPC) at www.pdpc.or.th (s.73).

Send rights requests by email to info@asiaglobaltracking.com from the email address you use to sign in to the App. We will act without undue delay and within 30 days of receiving your request. For account deletion, see the account and data deletion page. In some cases we may refuse a request where the law allows, and we will tell you why.

For vehicle, vehicle location and driver data, the customer company is the data controller. Please contact that company, or contact AGT and we will coordinate.

10. Minors

The App is for business users and is not directed at minors.

11. Changes to this policy

When we update this policy, we will post the new version on this page and update the effective date above.
